Terms and Conditions

  1. Responsibility and Force Majeure
    Publi Creations disclaims any responsibility for delays or inability to perform services due to circumstances beyond its control.
    In such circumstances, Publi Creations expressly declines all liability for any direct or indirect, foreseeable or unforeseeable, typical or atypical damages or losses, whether arising from tort, contract breach, culpa in contrahendo, or violation of obligation.
    Publi Creations will not be held liable for delays and/or failure to perform services due to or related in any way to:
    a) Failures or delays in activities undertaken by the Client as established in the Offer;
    b) Events, actions, or omissions such as strikes, lockouts, workforce shortages, riots, war, threats or preparations for war, fires, eruptions, sabotage, storms, floods, earthquakes, epidemics, pandemics, production facility breakdowns, building collapses, public authority orders, requisitions, shortages of raw materials, fuel, or any other energy sources, transportation blockages, and generally any event or circumstance preventing Publi Creations from fulfilling one or more of its contractual obligations (hereinafter referred to as "Force Majeure").
    When such events occur:
    - Publi Creations will inform the Client within a reasonable timeframe.
    - Publi Creations will be released from its contractual obligations and shall not be liable for damages or breaches of contract if the impediment prevents performance.
    In case of free registration and if the event is postponed or canceled, no compensation can be claimed.
    If the impediment or event is temporary, the consequences mentioned above will only apply as long as Publi Creations is unable to fulfill its contractual obligations. Once the impediment ends, Publi Creations will notify the Client within a reasonable timeframe.
    If the impediment significantly deprives Publi Creations of what it was reasonably entitled to expect under the Contract, or if the duration of the impediment:
    (i) exceeds 60 days, if it begins no earlier than 180 days before the start of the Meeting;
    (ii) exceeds five working days, if it begins no earlier than 20 days before the Meeting; or
    (iii) lasts at least one working day, if it begins within the five days preceding the Meeting or during the Meeting, Publi Creations may terminate the Contract by notifying the Client within a reasonable timeframe.
    Should the above apply, and if the Client has derived any benefit from actions undertaken by Publi Creations under the Contract, the Client shall pay Publi Creations a sum equivalent to the value of such benefits.
    Without prejudice to the above, in case of event cancellation due to Force Majeure, Publi Creations will refund the amounts paid under the Contract, minus (i) any documented penalties applied by Publi Creations' suppliers (e.g., hotels, restaurants, airlines) that cannot be recovered, and (ii) a 10% fee calculated on the total of (i) for activities performed by Publi Creations.
    Il est convenu que Publi Creations peut reporter le remboursement au Client en tenant compte de la période de remboursement demandée par les fournisseurs de Publi Creations afin de rendre à Publi Creations les sommes versées.
    In case of postponement due to Force Majeure:
    (i) Publi Creations will retain any amounts already paid as an advance.
    (ii) Publi Creations will make its best effort to:
    a. Reschedule the Services to match the new Meeting date.
    b. Minimize penalties imposed by its suppliers for rescheduling, with all such penalties borne by the Client.
